Fall Update: 3rd Street Litigation Status

Currently we await a decision by the Commonwealth Court on whether it will reinstate the 2011 Stipulation Agreement between Media Borough, Broomall’s Lake Country Club (BLCC), and Delaware County regarding the Dam/Bridge at Third Street in Media.

As of early October 2013, attorneys for Media Borough and BLCC continued to submit briefs in the Commonwealth Court of Pennsylvania.  We expect a decision from the Commonwealth Court within the next several weeks.

The current litigation has stopped forward progress on project design and does not address the questions of immediate dam safety, dam ownership or environmentally best practices. Friends of Glen Providence Park continues to support dam removal, stream restoration and an environmentally-sensitive connection between Upper Providence and Media Borough.
